COUNCIL COMMON POSITION
of 13 September 1999
amending Common Position 1999/261/CFSP concerning Libya (1999/611/CFSP)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union and, in particular, Article 15 thereof,

Whereas:

(1) On 16 April 1999 the Council adopted Common Position 1999/261/CFSP(1) suspending the restrictive measures taken against Libya on the basis of United Nations Security Council Resolutions (UNSCR) 748(1992) and 883(1993) and confirming the measures originally decided by the Member States on 27 January and 14 April 1986 against Libya's support for terrorism;

(2) Article 3 of that Common Position provided that it would be reviewed in the light of the report to be submitted by the UN Secretary-General on Libya's compliance with the remaining provisions of UNSCRs 731(1992) and 748(1992), in accordance with paragraph 16 of UNSCR 883(1993);

(3) On 30 June 1999 the UN Secretary-General submitted the said report which, in the part referring to renunciation of terrorism, cited several elements suggesting that recent acts by the Libyan authorities were indicative of the Libyan Government's renunciation of terrorism;

(4) The European Union therefore deems it appropriate to lift the remaining restrictive measures against Libya with the exception of the arms embargo,

HAS ADOPTED THIS COMMON POSITION:

Article 1

Common Position 1999/261/CFSP is hereby amended as follows:

(a) in Article 2, subparagraphs (b),(c) and (d) of paragraph 1 are deleted;

(b) Article 3 shall be replaced by the following:

"Article 3
This Common Position will be reviewed within 6 months or as the need arises."

Article 2

This Common Position shall take effect on the date of its adoption.

Article 3

This Common Position shall be published in the Official Journal.
